π Terms of Service
When using Kuraport (hereinafter "the Service"), you are required to read and agree to all provisions of the Kuraport Terms of Service (hereinafter "these Terms").
Article 1 (Application)
- These Terms set out the conditions for using the Service provided by the Kuraport operator (hereinafter "the Operator"). Users are deemed to have agreed to all of these Terms when they use the Service in any manner, including browsing content, posting, or making purchases.
- All rules posted on the Operator's website regarding use of the Service constitute part of these Terms.
- If the content of these Terms differs from rules or other descriptions about the Service outside these Terms, the provisions of these Terms shall prevail. However, if a separate written agreement (hereinafter "Individual Agreement") is concluded between the user and the Operator, the provisions of that Individual Agreement shall take precedence over these Terms.
Article 2 (Definitions)
Terms used in these Terms have the following meanings:
- "The Service" means the service "Kuraport" operated by the Operator, including its website, related features, content, and all associated services.
- "User" means any individual or corporation that views, uses, or accesses the Service.
- "Registered User" means a User who has registered an account on the Service by the method specified by the Operator.
- "Content" means any text, images, data, information, or other material provided, displayed, posted, or distributed on the Service.
- "Posted Content" means Content posted, sent, or provided by a User through the Service.
- "Operator's Website" means the website managed and operated by the Operator to provide the Service.
Article 3 (Service Content)
The Service is a database service providing information about sake breweries across Japan. Users (hereinafter "users") can search and browse brewery information through the Service.
Article 4 (Prohibited Activities)
Users must not engage in any of the following activities when using the Service:
- Acts that violate laws or public order and morals
- Acts related to criminal activity
- Acts that destroy or interfere with the Operator's servers or networks
- Acts that may interfere with the operation of the Operator's service
- Collecting or storing personal information of other users
- Unauthorized access or attempts to do so
- Impersonating other users
- Advertising, solicitation, or sales activities on the Service without the Operator's permission
- Any other acts deemed inappropriate by the Operator
- Scraping or otherwise collecting data from the Operator's website; using automated means to register or access the Service; reproducing, modifying, redistributing, reverse engineering, or otherwise exploiting any part of the Service without permission
Article 5 (Suspension of Service)
The Operator may suspend or interrupt all or part of the Service without notice to users if any of the following circumstances arise:
- Emergency maintenance or inspection of computer systems related to the Service
- The Service becomes inoperable due to computer or communication failures, excessive access, unauthorized access, or hacking
- The Service becomes inoperable due to force majeure events such as earthquakes, lightning, fire, floods, power outages, or natural disasters
- Any other case where the Operator determines that suspension or interruption is necessary
Article 6 (Changes and Termination of Service)
The Operator may change the content of the Service without prior notice to users, and may terminate the Service with prior notice.
Article 7 (Disclaimer)
- The Operator makes no warranties, express or implied, regarding the accuracy, completeness, timeliness, usefulness, or fitness for a particular purpose of the information posted on the Service, and has no obligation to remedy any defects related thereto.
- Users shall use information obtained through the Service at their own judgment and responsibility, and the Operator shall not be liable for any damages arising from or in connection with the use or inability to use the Service.
- The Operator may change, add, suspend, or interrupt the content of the Service without prior notice to users, and shall not be liable for any damages incurred by users as a result.
- Any transactions, communications, or disputes between users and other users or third parties arising in connection with the Service shall be resolved at the user's own responsibility.
- The Operator may post advertisements of the Operator or third parties on any page of the Operator's website.
Article 8 (External Links and Third-Party Information)
- The Service may contain links to websites or services operated by third parties, but the Operator makes no warranties regarding the content, accuracy, legality, or safety of such websites or services.
- The Operator shall not be liable for any damages arising from a user's use of third-party websites or services through the Service.
- Information, materials, or data provided by third parties on the Service are provided under the responsibility of such third parties, and the Operator bears no responsibility for their content.
Article 9 (Limitation of Liability)
- Except in cases of willful misconduct or gross negligence by the Operator, the Operator shall not be liable for any damages arising in connection with the Service, regardless of the legal basis. Even if the Operator is found liable, its liability shall be limited to direct and actual damages, and the Operator shall not be liable for indirect, special, incidental, or consequential damages, loss of profits, data loss, or business interruption.
- The Operator shall not be liable for any damages arising from a user's use of third-party websites or services through the Service.
- Where the Service is provided free of charge, the Operator shall not be liable for any damages whatsoever, notwithstanding the preceding provisions.
Article 10 (Copyright)
The copyright or intellectual property rights of content posted on the Service belong to the Operator or third parties who hold such rights. Users may not reproduce, repost, distribute, or otherwise use such content without authorization.
Article 11 (Protection of Personal Information)
The Operator's handling of users' personal information shall be governed by the separate Privacy Policy, and users agree to the Operator's handling of their personal information in accordance with that Privacy Policy.
Article 12 (Changes to Terms)
- The Operator may amend these Terms when deemed necessary.
- When amending these Terms, the Operator will notify users of the effective date and content of the amended Terms by posting on the Operator's website or through other appropriate means.
- The amended Terms shall take effect from the effective date stated in the preceding paragraph, and users who continue to use the Service after the amendment shall be deemed to have agreed to the amended Terms.
Article 13 (Severability)
Even if any provision or part of these Terms is determined to be invalid or unenforceable under the Consumer Contract Act or other applicable laws, the remaining provisions and the remaining parts of any partially invalidated provision shall continue in full force and effect.
Article 14 (Governing Law and Jurisdiction)
These Terms shall be governed by and construed in accordance with the laws of Japan.
In the event of any dispute relating to the Service, the court having jurisdiction over the location of the Service shall have exclusive jurisdiction.
